What is mediation?

Mediation is an effective way of resolving disputes without the need to go to court. The mediator, who is an independent third party, helps both sides come to an agreement. Mediation can help settle many disputes and situations. This can include consumer disputes, contract disputes, family disputes and neighbourhood disputes. In particular, KNBP focus on family disputes. Our mediator’s will help both parties reach a solution to their problem, the outcome will then be happily accepted by both parties. Our mediator’s are neither biased or judgemental. We focus on developing effective communication and building agreements between both parties.

Mediation cannot be forced upon both parties, it is a voluntary process and can only take place if both parties agree. KNBP keep any other information outside the mediation hearing strictly confidential. An important factor to remember is that if no agreement has been made, you can still proceed to court. The details about what went on at the mediation will not be disclosed or used at a court hearing.

What are the benefits?

Mediation can be a cheaper option to going to court. Along with this, it can be a quick and less stressful process.

In essence you have more control, once the settlement has been reached a mediation agreement can be drawn up. Both parties can keep the mediation agreement as they have prepared the terms themselves.

In terms of court and other legal action, the mediation is completely confidential and information cannot be discussed.

Please comment on our forum about your experiences or feelings about mediation.
